SCEA has filed a motion to dismiss a class action brought against the company for its removal of the PS3's "Other OS" feature, which allowed users to install Linux on the system. Sony argues that the lawsuit, a consolidation of seven similar suits filed last spring, fails to present evidence that the company overtly advertised Other OS in its marketing campaigns or on PS3 packaging.

Sony's filing also claims that the PS3 warranty, license agreement and the PlayStation Network Terms of Service "specifically provide PS3 purchasers with a license, not an ownership interest, in the software and in the use of the PSN, and provide that SCEA has the right to disable or alter software features or terminate or limit access to the PSN, including by issuing firmware updates," according to court documents obtained by IGN. (Other OS was removed with a firmware update; and users who decline any update are barred from PSN.)

Additionally, Sony has requested that the "class" allegations be stricken from the suit because the plaintiffs did not all use Other OS in the same way. In fact, one of them never used the feature at all. With Sony presenting some seemingly solid grounds for the lawsuit's dismissal, it might be prudent for the plaintiffs to call a key witness to the stand when the two parties meet before a judge on November 4. How about ... the United States Air Force?

Metal Gear Solid Peace Walker featured nonsensical Monster Hunter content, so it should come as no surprise that Monster Hunter Portable 3rd returns the favor. Well, we say that, but seeing The Boss in Monster Hunter is a shock no matter how prepared we thought we were.

The PSP port of Monster Hunter 3 will include armor to make your male or female character look like Snake or The Boss, respectively, along with Metal Gear-inspired costumes for your Felyne companions -- who can now hide in cardboard boxes (just like our cats). The cognitive dissonance is a free, unadvertised bonus.

This morning, Team17 announced the forthcoming Steam/XBLA release of Alien Breed 2: Assault, the followup to last year's Alien Breed: Impact. Adding to the single-player and co-op campaigns this time around is a new "Survivor Mode," which has players assaulting "endless waves of intense alien horde attacks." The developer also promises a new species to brutally murder en masse: "Webber" aliens.

Picking up the game on XBLA nets players some "exclusive" Avatar award items in a "Barnes" helmet and body armor, each of which must be earned through game objectives ("killing a set number of aliens" and finishing the single-player campaign, respectively). The title arrives this Wednesday on both XBLA and Steam.

No doubt, most gamers are aware that this fall the United States Supreme Court will be taking up the legal challenge to California’s law that would limit the sale of computer and video games and chill the creative freedoms of our industry’s artists.

The issue at hand is whether a state can limit access to video game based on their content. If the California succeeds at the Supreme Court, then states across America could begin limiting access to video games and stores could stop selling games because they won’t know what titles fall under a particular state’s laws and which don’t. How does that affect you? Imagine walking into your local game retailer and finding out they don’t sell games you want because they’re worried about government intervention. This isn’t hyperbole; it’s a very real scenario that could happen if California succeeds.

This month, the industry achieved a milestone in fighting for video games. The ESA filed with the U.S. Supreme Court a legal brief that strongly defends the rights of gamers, video games, and the artists who work so hard to create those games.

Others recognize the seriousness of this situation and have stepped up to defend video games, the First Amendment and promote education about parental controls and the video game industry’s rating system. No less than renowned comic book creator, Stan Lee, who brought to life such iconic figures as Spider-Man, the X-Men, and the Hulk, has encouraged gamers to organize and take action. Stan highlighted the video game industry’s great work in helping parents by providing a leading rating system and parental controls—which, when taken together, help ensure that the games kids enjoy are parent-approved. His open letter encouraged everyone to join the Video Game Voters Network, which is the grassroots coalition of voting-aged gamers who want to be kept updated on legislative threats to computer and video games.

Following Stan’s lead, I’m writing today to encourage you to join the VGVN. Politicians will listen when their constituents weigh in on issues and we need gather an army to fight for games. Please consider joining the VGVN to aid in the defense of video games. And, tell three of your friends to do the same! Joining is free and easy to do. Go to www.vgvn.org and sign up!

Halo: Reach took the top spot on the UK all-formats sales chart last week. According to Chart-Track, Reach's first-week sales were 20,000 units ahead of Halo 3 and 200,000 more than Halo 3: ODST. The members of Noble 6 also had the fifth biggest launch ever in the UK, with the top four belonging to Modern Warfare 2 (Xbox 360 and PS3), GTA: San Andreas (PS2) and GTA IV (Xbox 360), respectively.

Likely a distant, but still impressive, debut at the number two spot is PlayStation Move's Sports Champions. The only other Move-required games in the top 40 were Start the Party! (#29) and Ubisoft's Racket Sports (#32). Rounding out the top three was Mafia 2, which held the top sales spot for the three weeks prior.

Ubisoft's Prince of Persia: Forgotten Sands turned back time and went up the charts to fifth place last week, likely due to the movie's home video launch and retail promotions. Also, Ubi's Just Dance made it back into the top ten in eighth place. It gave us a good scare last week when the stalwart Wii-exclusive slipped to 11. Check out the UK top ten after the break.
