Not guilty. He was just making a joke. A really horrible and poorly constructed joke, but a joke nonetheless. It should actually be striked for flame, because he's insulting the person. He's saying they're really dumb. He didn't say it well, but he still said it.

You need to go back and look at the rules. Or get a forum slang dictionary, or something. Spam is a Stupid Pointless Annoying Message, which is like a random thing that has nothing to do with the topic. This, however, is derailing. Derailing is when someone says something, then someone replies, and it evolves into a conversation between however many of them who are derailing.
Although it was a bad joke, it was a joke, and that's derailing, not spam. It had something to do with the post he quoted. And derailing is not a strikeable offense. Not guilty.
