Reporting is not striking. Reporting is informing a mod of a post and letting them know it might be worth striking. Reporting a post does not mean the reporter thinks it's strikeworthy, it means they think it MIGHT be strikeworthy and are letting a mod know about the post and let THEM make the decision. The mod doesn't even have to strike it, they can just warn the poster. If you report something that upon further thought does not deserve striking, and it gets striked, striked person pleads not guilty, most agree it shouldn't be striked, etc, the reporter should take NONE of the blame. They simply let the mod know about the post. They are not responsible for any actions of the moderators.
This is annoying because I see many people complaining about how it shouldn't have been reported and not mentioning the mod or strike itself. This kind of blame discourages people from reporting, which means they might not report a post that deserves it, not informing a mod of a post that really deserves striking or at least warning. I will not tolerate any more of this misplaced blame in such a serious forum as the Court.
There are some rare cases where people report OBVIOUSLY undeserving posts that very well avoid any sort of strikable offenses. Such as someone randomly reporting Cid's Presidential Speech in General Discussion. Repeated offenses like these should be punished. Extreme cases like these are the only conditions for which a reporter should take any blame. A case like reporting Popple's "Post something you hate about the above poster" topic is not one of these. One could argue that it could lead to somebody taking it too far and flaming or flamebaiting the above poster. In this case I'd say not guilty since the strike is based more on possible actions of the repliers, not the topic committing any offenses itself, thus deserving of a lock and no strike. In a case like this and many others, a report would be fine. It would inform the moderator of the topic and let them handle it, the mod could just lock it. Like I said, reports inform mods of possible warn/lock/strike-worthy topics. Another example would be reporting a post that just falls short of flamebaiting anime-fans or something. The post could be reported, then a mod could warn the poster not to take it any further.
I think I've repeated myself enough, and used enough examples that you get my point. If a post is mistakenly striked, it is the fault of the moderator who striked it, the reporter is at no fault whatsoever. Unless of course it is an extreme case of stupid reporting of a post that does not deserve it at all. Even in those cases, a mod should definitely not strike it and it shouldn't go to court. If it does somehow get striked, it is the fault of stupidity of the reporter and EXTREME stupidity of the mod. Mods should never strike something unless they're really sure it deserves striking. This is unlike reporting because it is actually punishing the offender, not saying maybe the mods should think about punishing him. |
