You have to be pretty stupid if you pirate a game and connect online. Really. Very, very stupid, worthy of such a ban, actually. It's fine if you don't connect online using those games, from what I can gather. So, if I used homebrew to play Seiken Densetsu 3, they wouldn't find me out, even if I connected to purchase Secret of Mana from the VC store, hypothetically speaking. |

The only thing I find stupid is that you need to reformat your Wii.
If I'm not mistaken, that means it will rid your Wii of EVERYTHING, including memory of games, and VC's. Although, you could move those to an SD card, but then again, can't you do that with Homebrew? |
