Long version:

I called nintendo, and they said it was probably because I hyper-extended the screen, which is bullshit, because I am obsessive about things like that. Now they want to charge me $57.50 for a stupid broken piece of plastic that wasn't my fault anyways, and I still have a warranty, but they said it is voided because it was "physical damage", so I'm screwed warranty wise, and I sure damn well ain't going to pay half of what I bought it for to fix it.

Short version:

Nintendo's being a bitch. Is there any way I can glue it without making it so I can't open and close it? Because it keeps on falling shut because It's loose.

Is this how it looks like or is the crack on a different part of the hinge?

Also is your DS, a Nintendo DS Lite?

You could try gluing it with a tough kind of glue. I would try gluing the center part of the piece that is cracked. If that doesn't work, then I don't believe that you can do anything else, but pay for it.

Same thing happened to me... TWICE. Had to pay $50 both times even though all I did was open it for it to break.
