A) The 3DS has not been cracked. B) Nintendo is going to be in a world of hurt if they start bricking any 3DS that ever runs an unauthorized device.

Nintendo's biggest worry is that they know consumers can create better iterations of games.

See: Brawl Hacking, all the Sonic Fan Games, Mario Hacks, etc.

They only worry about that because it legitimizes the use of homebrew devices. Nintendo needs to realize that today is not like it was in NES days. Compare Nintendo's DSiWare Shop to Apple's App Store. Apple encourages anyone to make apps/games with cheap dev tools. Nintendo charges like 10 grand for a dev kit, if you are deemed worthy enough to buy one. Apple doesn't really care about piracy. Nintendo goes to great lengths to thwart piracy, even if it harms those who are just want to dabble in game development.
Guess who is going to lead the next generation of mobile gaming.
