I thought this was just the spotpass aspect of it? Closing the whole feature because kids like to send naked pictures of eachother is stupid, ESPECIALLY when the handheld in question has parental controls that can prevent this from happening in general.

To confirm, only the SpotPass mode of SwapNote/Letter Box/whatever you call it in your particular country has been disabled. I've heard one theory that this is due to people exchanging friend codes en-masse with random people on the web for Pokemon friend safari stuff who then start receiving inappropriate images via SwapNote, and another theory that this move is in preparation for the imminent release of Miiverse on 3DS (somewhat backed up by the fact that the same kind of abuse could potentially occur on the still-online Wii U Chat app).

Because it's clearly Nintendo's fault if people abuse their system and/or parents fail to regulate their children's online activity. Nintendo has been forced to take the lesser of two media backslashes here.
