Check out what Nintendo customer service told one gamer that lost his 3DS and eShop downloads with it.

Thanks for contacting us. I’m sorry to hear that your Nintendo 3DS is missing. We can help you transfer your data to a new system. Normally I would refer you to our website, however, the Nintendo 3DS data transfer issue you inquired about can only be addressed by speaking with you directly. We will need to verify some information in order to assist you, and due to that information’s sensitive nature we cannot do so through email. Therefore, once you have a new system we ask that you please give us a call.

At your earliest convenience, please contact our Consumer Service Department by calling 1-800-255-3700 any time between 6:00 a.m. and 7:00 p.m. Pacific Time, seven days a week. In order to speed things along, make sure to have your system with you when you call.

One point to note is that this particular person had their Club Nintendo account linked, so that might play a part in the response. Still, good news if you ever have this unfortunate event happen to you.
