Compare Nintendo's DSiWare Shop to Apple's App Store. Apple encourages anyone to make apps/games with cheap dev tools. Nintendo charges like 10 grand for a dev kit, if you are deemed worthy enough to buy one. Apple doesn't really care about piracy. Nintendo goes to great lengths to thwart piracy, even if it harms those who are just want to dabble in game development.
