Nyan Cat creator Christopher Orlando Torres and Keyboard Cat's owner Charles Schmidt have filed a copyright and trademark infringement lawsuit against Warner Bros. and 5th Cell over their creations' appearances in the Scribblenauts series.

The complaint, filed on April 22nd, alleges that developer 5th Cell did not seek permission to include either copyrighted character in their published products or in related promotional material. The original Nyan Cat and Keyboard Cat videos have each been viewed tens of millions of times on YouTube, making them "extremely valuable for commercial uses," according to the complaint.

"Plaintiffs claim that Warner Bros and 5th Cell's trademark infringement was willful and intentional and are requesting an award of treble damages and requesting the case be deemed exception under 15 U.S.C. § 1117(a), thereby entitling Plaintiffs to an award of reasonable attorneys' fees," intellectual property-focused attorney blog Milord & Associates notes.

Plaintiffs Schmidt and Torres additionally seek an injunction against the sale of Scribblenauts products until the matter is resolved.

The Scribblenauts series allows players to summon a wide variety of memes during gameplay, for both practical purposes and comedic effect. Keyboard Cat has appeared in every series entry to date, while Nyan Cat is a more recent addition, appearing only in Scribblenauts Unlimited.

REPOSTED AS A REVIEW!

So back in 2009, I hadn't played too many RPGs. In fact, they basically died to me. Then I got this one game.

Have you guys ever heard of Black Sigil? It's a NDS game that's supposed to be like a SNES RPG, and they did really well with it! It does have it's obvious flaws, but it doesn't deserve some of the shit it gets. The soundtrack is really well done and the characters are fairly well developed.

It's very buggy with emulators and so far has only worked with DeSmuME. The only thing I dislike about this game is it's INSANE encounter rate. Sometimes you can't take 2 steps without getting *crag*ed up your ass. Oh, and good luck doing everything you'll want to do in this game without a walkthrough.

From me, Black Sigil get's a 7.5/10.

I'm not sure how many Nintendo fans know about Mach Rider. Unless you were playing games in the NES days, it may be a forgotten or even unknown relic. Could the mechanics and storyline of Mach Rider be perfect to attract a new type of gamer to Nintendo platforms?

Whoops. A Hong Kong Starbucks made one customer unhappy after totally screwing up a first name. Imagine that! A Starbucks spelling fail? Impossible. On the Hong Kong Starbucks' Facebook page (via HongWrong), a customer posted an image of the fail, writing: This is my sister's cuppa [SIC] from your HKU branch. Fancy your staff not being able to spell an American name like Virginia. Forgiving she has been with every misspelled cup. Her cup was once 'Virgin'. Every Starbucks experience for her has been coupled with fear and anticipation. But THIS is just UNACCEPTABLE. Starbucks HK, you have to buck up or just not spell your customer's name anyway. It is a derogatory attitude even if it is unintentional. What do you have to say about this? On Facebook, the comment has been liked over a thousand times. Some are calling the photo a fake, while others think it's unfair to expect Hong Kong's non-American staff to be able to spell American names. Starbucks is a global corporation! If real, I doubt this was done to be mean. Well, I sure hope it wasn't. This isn't the first "Vagina" Starbucks spell fail—heck, there's even a whole Tumblr of assorted name fails. It is the first fail I can recall that has made a customer angry enough to turn the situation into some sort of vaguely international issue. While it's unfortunate that the customer had such an unpleasant experience, I think the one takeaway is that even though going to Starbucks filled her sister with "fear and anticipation", she continued to patron Starbucks. Readers are letting us know that Nintendo has this evening taken the very direct step of sending out messages to Wii owners. Not to tell them that their system is being updated. To tell them their system is now out of date. Continuing a recent exercise in the company finally realising "holy shit we really should have called this thing something else", Nintendo's message spells out as explicitly as it can that the Wii U is "an entirely new system". Not a re-release of the Wii, not an add-on, not a variant, an entirely new system. OK? I've never seen a console need to be marketed like this before. When you need to spell things out so clearly, and directly message every single owner of your previous console, well. You appear to have a marketing problem. And a sales problem. Did you know the first two Pokémon sequels were supposed to let you ride a skateboard? It was advertised. Briefly. Then....just quietly removed and never spoken of again. Turns out it's still in the game's code, though, so in addition to combing through old Japanese mags for mention of the item, Aria over at Glitterberri has translated some fan's testing of the skateboard's unused code left sitting on the cartridges.
